The Federal Office of Justice (FOJ) has announced that the expected date of entry into force of the revised Federal Act on Data Protection (FADP), together with its implementing ordinance, is September 2023. According to the FOJ, the finalized implementing ordinance will presumably be published one year earlier, i.e. September 2022. This is to give companies enough time for the implementation which may be time-consuming, and considering that the revised FADP essentially contains no transition periods. The Federal Council will ultimately decide on the effective date.
Currently, the draft ordinance is under revision following the prior consultation. Consultation within the administration office will follow.
